Terms and conditions for using Kakao Link Open API

[Kakao Link Open API (Application Programming Interface) service (the “Service”)] is information disclosed by Kakao in order to allow convenient use of the function that enables links to be sent from the applications operated by a developer or web page to Kakao Talk (Kakao Link). Using this service requires compliance with the following terms and conditions.

Basic principles for using the Service

  1. Applications or web pages created by developers using the Service shall not contain any illegal contents that constitute breach of a third party’s rights or violation of laws including infringement of intellectual property rights such as trademark or contents that are socially unacceptable, such as sensational, violent or detestable materials. To “contain” in these contexts means not only directly containing the materials in question but also those cases where there could be indirect links to such materials.
  2. The user of Service should comply with these terms and conditions and guidelines and notices announced in relation to the use of Kakao Link. The user of Service shall not engage in any conduct that could disrupt the Service or damage Kakao’s reputation.
  3. Developer shall not, when using the Service, engage in any illegal hacking, reverse engineering, any abuse through abnormal means, or attempts to exceed use of network in relation to other network services such as Kakao Link, Kakao Talk, etc.
  4. Unless approved otherwise by Kakao, using the Service to conduct sales activity or causing a third party to engage in sales activity is prohibited.
  5. Developer shall assume responsibility in relation to using the Service. Kako shall not be liable for any loss unintended by Kako.
  6. Developer using the Service shall not hold itself out as the operating entity of Kakao Link or as an agent of Kakao.
  7. The license to use the Service may not be transferred, donated or leased to a third person nor could it be provided as collateral.
  8. In the event there are 30,000 or more calls per day in developer’s application or web page, the developer shall notify Kakao Link’s manager in advance for separate service use procedure.
  9. Please comply with the guidelines and notices separately provided by Kakao in relation to the use of the Service.

Change of service

  1. If necessary and reasonable causes exist in relation to the operation of the Service, the specific scope of the Services, such as purpose of use, using entity and use criteria, may be restricted or changed.
  2. The aforementioned changes will be announced through the Service homepage unless there are any special circumstances which make prior notice difficult.

Temporary suspension of Service

In case of any of the following, the Service may be temporarily suspended following an advance notice. Provided, however, in the event there are unavoidable causes such as force majeure events which make advance notice difficult, the Service may be temporarily suspended without any notice.

  1. Any day designated by the company for periodic system maintenance, system augmentation, and system exchange.
  2. When technical defects have been discovered in relation to provision of the Service
  3. When adding a new API Service
  4. When circumstances beyond control has occurred as a result of system error, act of God or other comparable force majeure events.

Restriction of Service

Developers using the Service shall not engage in the following. In the event of non-compliance, such developer may be restricted from using the Service prior to or after such non-compliance.

  1. Damaging or intentionally disrupting the Service.
  2. Falsely or incorrectly entering parameters required for using the Service (e.g., App ID, app name, installation URL, etc.)
  3. Distributing to others information, statements, drawings, sounds or videos whose contents go against public order and good social values through transmission, posting, electronic mail or other methods.
  4. Collecting or using private information without the clear consent of the owner of the information through the Service.
  5. In the event that applications and web pages to which Service is applied are linked directly or indirectly with illegal activity.
  6. Other activities in violation of law.

Notice of Intellectual Property Rights

  1. Kakao reserves all rights with regard to the Service including intellectual property rights. Accordingly, Developer shall not mislead the users into believing that Kakao is directly providing the application or web page or that such applications or web pages are being provided under some contractual relationship with Kakao, by placing Kakao’s name, logo, symbol, icon, etc. in its applications or web pages.
  2. Kakao may suspend the Service temporarily or permanently for purposes of accomplishing the objectives of the Service and for other business reasons, and it may also change the contents of the Service.
  3. Kakao has exclusive control over the contents and formats of the Service contents and data. Accordingly, developer using the Service may not arbitrarily delete or change them.

Restriction on use and legal demands

  1. In the event developer using the Service has violated these terms and conditions or guidelines or announcements provided by Kakao, Kakao may prohibit such developer from using the Service temporarily or permanently.
  2. In the event Kakao has incurred damages as a result of the foregoing violations, it may demand the violator for compensation as well as take other criminal procedures.

Indemnification

  1. In the event developer using the Services causes damages to a third party in violation of these terms and conditions or guidelines and announcements provided by Kakao, Kakao shall not be responsible for such damages.
  2. Permission to use the Service does not constitute a guarantee of any profit through the use of the Service. Kakao shall not be responsible for any loss of earnings caused by the use of the Service.
  3. Kakao has no duty to involve itself in disputes that arise between developers who use the Service or between the developer and third parties, nor does it have any duty to pay compensation for damages caused thereby. In the event a demand is made on Kakao, the party responsible for such demand shall indemnify Kakao at its own expenses and responsibility.

Governing law and jurisdiction

  1. Any matters not set forth in these terms and conditions shall be in accordance with the guidelines and announcements made separately by Kakao. Any matters not set forth in these terms and conditions or the guidelines and announcements shall be in accordance with relevant laws and commercial customs and practices.
  2. Any dispute arising in relation to the use of the Service between Kakao and developer shall be submitted to the trial court at the Seoul Central District Court.
